Users Terms and Conditions for SA Businesses Marketplace

  1. Acceptance of Terms 

By accessing or using SA Businesses Marketplace on www.sabusinesses.co.za, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please do not use the Site.

  • Eligibility

You must be at least 18 years old to use this Site. By using the Site, you represent and warrant that you meet this requirement.

  • User Accounts

To buy or sell products on the Site, you must create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

  • Marketplace Transactions

SA Businesses Marketplace provides a platform for buyers and sellers to connect. We are not responsible for the quality, safety, or legality of items listed, the truth or accuracy of listings, or the ability of sellers to sell items.

  • Payment Terms

All transactions made through the Site are processed through Pay Fast. By using the Site, you consent to the processing of your payment information in accordance with Pay Fast’s terms and privacy policy.

  • User Conduct 

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. Prohibited activities include, but are not limited to:

– Posting false or misleading information

– Engaging in fraudulent activities

– Harassing or threatening other users

– Pornographic materials

  • Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of SA Businesses Marketplace or our licensors and is protected by copyright and other intellectual property laws.

  • Limitation of Liability

To the fullest extent permitted by law, SA Businesses Marketplace shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any products purchased through it.

  • Indemnification

Seller Terms and Conditions for SA Businesses Marketplace

  1.  Acceptance of Terms

By registering as a seller on SA Businesses Marketplace on www.sabusinesses.co.za , you agree to comply with and be bound by these Seller Terms and Conditions. If you do not agree, please do not register as a seller.

  • Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to sell products on the Site. By registering, you represent and warrant that you meet these requirements.

  • Seller Account Registration

You must create a seller account to list products on the Site. You are responsible for providing accurate and complete information during registration and for maintaining the confidentiality of your account credentials.

  •  Listing Products 

You are responsible for creating accurate product listings, including descriptions, prices, and images. By listing a product, you represent and warrant that:

– You have the right to sell the item.

– The item complies with all applicable laws and regulations.

– The listing is accurate and not misleading.

  • Fees and Payments 

SA Businesses Marketplace charges a 10% fee for all transactions completed through the Site. You agree to pay all applicable fees. Payment processing will be handled by Pay Fast, and you consent to their terms and privacy policy.

  • Order Fulfilment 

As a seller, you are responsible for fulfilling orders in a timely manner. This includes shipping products promptly and providing accurate tracking information. You must communicate with buyers regarding order status and any potential delays.

  • Returns and Refunds 

You must establish and communicate your return and refund policy to buyers. You agree to comply with SA Businesses Marketplace’s guidelines regarding returns and refunds.

SA Businesses Marketplace Returns and Refunds Policy

Thank you for shopping at SA Businesses Marketplace. Your satisfaction is our priority. Please read our returns and refunds policy carefully to understand your rights and responsibilities when purchasing items from our marketplace.

 1. General Policy

– All purchases made through SA Businesses Marketplace are subject to the terms of this returns and refunds policy.

– This policy applies to items sold by third-party sellers on our platform, unless otherwise specified by the seller.

2. Eligibility for Returns

– To be eligible for a return, items must be in their original condition, unused, and in the original packaging.

– Certain items may be non-returnable, including but not limited to:

  – Personalized or custom-made items

  – Perishable goods

  – Digital products (e.g., software, eBooks)

  – Intimate or sanitary items

3. Return Window

– Customers have 2 days from the date of receiving the item to initiate a return.

– To initiate a return, please contact the seller. If the seller is not forthcoming please contact SA Businesses Market place on admin@sabusinesses.co.za

4. Return Process

1. Request a Return: Contact the seller or our customer service on admin@sabusinesses.co.za

2. Pack the Item: Securely pack the item in its original packaging, including all accessories, manuals, and documents.

3. Shipping Label: Once your return is approved, you can then send it back to the seller who will organise a replacement or refund

4. Ship the Item: Send the item back to the designated address within 2 days approval.

5. Refund Process

– Once the returned item is received and inspected, you will be notified of the approval or rejection of your refund.

– If approved, your refund will be processed within 7 business days, and a credit will automatically be applied to your original method of payment.

– Please note that depending on your bank or payment provider, it may take additional time for the refund to be reflected in your account.

6. Exchanges

– If you wish to exchange an item for a different size or color, please follow the return process and place a new order for the desired item.

7. Seller’s Policy

– Each seller may have their own return and refund policy. Please check the specific seller’s policy on the product page before making a purchase.

– If a seller’s policy differs from the marketplace policy, the seller’s policy will take precedence.

8. Damaged or Defective Items

– If you receive a damaged or defective item, please contact our customer service team within [insert number] days of receipt with photographic evidence.

– We will work with you and the seller to resolve the issue promptly, which may include a refund, exchange, or repair.

b. Counterfeit or Trademark-Infringing Products

– Items that infringe on the intellectual property rights of others, including counterfeit products and pirated software.

c. Hazardous Materials

– Explosives, flammable materials, and other hazardous substances that pose a risk to health and safety.

d. Drugs and Drug Paraphernalia

– Illegal drugs, controlled substances, and any items intended for drug use, including paraphernalia.

e. Adult Content

– Pornographic or sexually explicit materials, including adult toys and publications.

f. Stolen Property

– Any items that are stolen or have been obtained through illegal means.

 g. Animals and Pets

– Live animals, endangered species, and any products derived from endangered or protected species.

h. Weapons and Firearms

– Firearms, ammunition, explosives, knives, and any items that are classified as weapons.

 i. Personal Data and Information

 j. Non-Fungible Tokens (NFTs)

– Digital assets that represent ownership or proof of authenticity of a unique item or piece of content, unless specifically allowed by SA Businesses Marketplace.

3. Reporting Violations

4. Enforcement

– SA Businesses Marketplace  reserves the right to remove any listings that violate this policy without prior notice.

– Sellers found to be repeatedly violating this policy may have their accounts suspended or permanently banned from the platform.

We reserve the right to suspend or terminate your seller account at any time for any reason, including but not limited to violations of these Terms.
